RE: The tariff classification of infant boy’s apparel from the Philippines.

Dear Mr. Stone:

In your letter dated September 30, 2010, you requested a tariff classification ruling. As requested, the sample will be returned to you.

The submitted sample is a babies’ one-piece bubble type romper. The sample, Style 5408, is made of sheeting fabric that is 65% polyester, 35% cotton. The garment features short hemmed sleeves, a round neckline with peter pan collar; a pieced chest panel with smocking, embroidery and appliqué work; a three button back opening, elasticized fabric at the leg openings and a three metal snap crotch. The item is sized for newborn boy babies.

The applicable subheading for Style 5408 will be 6209.30.3010, Harmonized Tariff Schedule of the United States, (HTSUS), which provides for babies’ garments and clothing accessories, of synthetic fibers, other, sunsuits, washsuits and similar apparel. The duty rate will be 16% ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
